An EBA, or Enterprise Bargaining Agreement, is a legally binding agreement in Australia made at the workplace level between an employer, employees and their union that sets out wages, working conditions, allowances, and other entitlements.
EBA’s tailor employment terms to a specific workplace and must be approved by the Fair Work Commission. For an EBA to be enforceable, a majority of employees covered, who choose to cast a vote, must vote to accept it. It must also provide terms and conditions that are better off overall compared to the applicable modern award. EBA’s must also meet the minimum entitlements set out in the National Employment Standards (NES), which apply to all employees.
The AMIEU has negotiated every EBA at ACC for production workers since ACC commenced its operations and has successfully, with the support of your onsite employee committees, built terms and conditions and wages into your EBA’s that are industry leading.
ACC employees covered by the ACC Cannon Hill Production Enterprise Agreement are being asked to vote on a replacement EBA.
The vote will take place onsite at ACC on Wednesday 17th & Thursday 18th September 2025.
During the past few weeks ACC has provided you with access to all the relevant information about the EBA proposal. The AMIEU has also provided you newsletters via the AMIEU Website and SMS’s sent to you on 23/6/25 & 21/7/25. Please refer to the newsletter sent to you on 23/6/25 for more detail about the employee claims we could not resolve with ACC and please consider all the information you have been provided to assist you to make an informed vote.
It is very important to make your vote count.
The process for voting is a secret ballot held onsite. It is very important that you do vote. The only requirement to determine an EBA is that a majority of those who choose to cast a vote either accept or reject a proposal.
It is not required that a majority of the employees participate in the EBA vote, therefore, only those who choose to cast a vote matter.
A lack of participation can skew a result in an unintended way; it can also allow the employer to think that people are unsure or don’t care very much about their EBA. This leaves workers in a poor position should we be wanting to restart negotiations for a better offer.
What members should be aiming for is a big voter turnout.
Please also note that a negative/no vote on its own will not secure a better offer from ACC. The only way to influence a better outcome is to have a good voter turnout and Union members who are willing to take action if ACC fails to listen.
The AMIEU wants ACC to hear your voice. AMIEU delegates will be scrutineering the entire vote and the count. You can be sure your vote is secret and secure. Make your vote count!
